They can, they are called for-profit colleges (University of Phoenix)


From the AAU..."The vast majority of private and public universities and colleges are tax-exempt entities as defined by Internal Revenue Code (IRC) Section 501(c)(3) because of their educational purposes – purposes that the Federal government has long recognized as fundamental to fostering the productive and civic capacities of citizens."

When the organizational community, i.e., conference, starts orienting around profit and less about their mission, they risk losing that vital tax status.
